New Research Publication from the Doctoral School
Dr Antonio Serrano, Professor of Commercial Law at Universidad Rey Juan Carlos in Madrid, has published the research conducted during his stay as a visiting researcher at eUniv’s J. H. Newman Doctoral School. The study, entitled “La automatización de la justicia digital: ODRS, Inteligencia Artificial y la redefinición transnacional de las garantías procesales”, is included as Chapter V of the book “¿Justicia algorítmica?: Inteligencia Artificial y métodos adecuados de gestión de conflictos tras la Ley Orgánica 1/2025”, edited by Professors Marta Gonzalo and María del Carmen Cazorla and published by Editorial Aranzadi.
In his research, Dr Serrano analyses the transition from digital justice towards a model of algorithmic justice and the impact of artificial intelligence on continental procedural safeguards. The study examines the tension between technical efficiency and fundamental principles such as the right to effective judicial protection, the right of defence, and the requirement to provide reasons for judicial decisions, all of which may be threatened by the opacity of “black box” systems. The study addresses the EU regulatory framework, highlighting the AI Act and the Digital Services Act as key instruments requiring human oversight and transparency. It also assesses the limits imposed by international public policy under the New York Convention in relation to automated arbitral awards. Finally, it analyses the Brussels Effect as a driver of global ethical and evidentiary standards that make innovation subject to the rule of law.
